1. INTRODUCTION These Terms of Service (“Terms”) govern access to and use of the M.Y.T.E mobile application (the “App”), the M.Y.T.E website and parent dashboard (the “Website”), and all related products, subscription features, content, communications, and AI-powered functionality, including but not limited to “Lucy’s Lightbulb” (collectively, the “Services”).
The Services are operated and provided by MYTE Mission Children and Adolescents Skills Development – FZCO, a company registered in the United Arab Emirates (‘the Operator’, ‘we’, ‘us’, or ‘our’). Please note that the M.Y.T.E brand, software architecture, and all associated intellectual property are owned by M.Y.T.E Mission Ltd (UK) and are provided to the Operator under a strategic licensing agreement. These Terms constitute a legally binding agreement between you and the Operator. By creating an account, subscribing to a plan, downloading the App, accessing the Website, or otherwise using any part of the Services, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to these Terms in their entirety, you must not access or use the Services.
1.1. Acceptance of Terms
If you are a parent or legal guardian creating an account for a child, you acknowledge and agree that you are the primary account holder and that you are solely responsible for supervising and monitoring the child’s use of the Services. You accept these Terms on your own behalf and on behalf of the child associated with your account. You represent and warrant that you are legally authorized to provide consent for the child’s participation and that you have full authority to enter into this agreement.
You further acknowledge that you are responsible for all activity conducted under your account and any associated child profiles, whether or not such activity was directly authorized by you. You agree to maintain the confidentiality of your login credentials and to notify us promptly of any unauthorized access or suspected misuse. We reserve the right to modify these Terms at any time. If material changes are made, we will provide notice through the App, Website, or via email. Continued use of the Services after such notice constitutes acceptance of the updated Terms.
1.2. Definitions and Explanations
For purposes of these Terms, the following definitions apply:
- “App” means the M.Y.T.E mobile application made available on iOS, Android, or other supported platforms.
- “Website” means the official M.Y.T.E website, parent dashboard, and any associated web-based interface.
- “Services” means collectively the App, Website, subscription features, AI-powered tools (including “Ask Lucy” and “Lucy’s Lightbulb”), content, communications, dashboards, and all related functionality operated by M.Y.T.E.
- “M.Y.T.E,” “we,” “us,” or “our” refers to MYTE Mission Children and Adolescents Skills Development – FZCO (the ‘Operator’), which manages the daily delivery of the Services.
- “Licensor” refers to M.Y.T.E Mission Ltd (UK), the owner of the intellectual property rights underlying the Services.
- “Parent,” “Guardian,” or “Account Holder” means the legally authorized adult (18 years or older) who creates, owns, manages, and controls the subscription account and associated child profiles.
- “Child” or “Minor” means an individual under the age of 18 who accesses or uses the Services under a parent-controlled account.
- “User” means any individual who accesses or uses the Services, including parents, guardians, and children.
- “User-Generated Content” means any content submitted, created, uploaded, recorded, stored, or transmitted through the Services by a User, including but not limited to text entries, journal responses, prompts, images, audio recordings, video recordings, AI interactions, and shared materials.
- “AI Features” means any artificial intelligence, machine learning, or automated systems integrated into the Services, including but not limited to response generation, content analysis, moderation tools, prompt interpretation, and Suggested Activities.
- “Suggested Activities” means AI-generated recommendations that may include emotional exercises, breathing techniques, mindfulness practices, light physical movements, reflection prompts, or similar wellbeing-related suggestions.
- “Subscription” means a paid recurring access plan (monthly, annual, or otherwise specified) granting access to certain features of the Services.
- “Third Party” means any individual or entity other than M.Y.T.E and the Account Holder, including but not limited to teachers, therapists, educational institutions, secondary guardians, service providers, payment processors, or regulatory authorities.
- “Personal Information” means any information that identifies or relates to an identifiable individual, as defined under applicable data protection laws.
- “Applicable Law” means all relevant laws, regulations, and statutory requirements governing the Services, including but not limited to data protection, consumer protection, child safeguarding, and digital services laws in the jurisdictions where the Services are offered or accessed.
2. ELIGIBILITY AND AGE REQUIREMENTS
The Services are designed for use by children and adolescents between the ages of 4 and 18, strictly under active parental or legal guardian supervision. For users located in the United States, children under the age of 13 may only use the Services after verifiable parental consent has been obtained in accordance with the Children’s Online Privacy Protection Act. For users located in the United Kingdom or the European Economic Area, children under 16 require parental authorization where mandated by applicable data protection laws. Parents or legal guardians must be at least 18 years of age to create an account, purchase a subscription, manage billing information, control privacy settings, or authorize data sharing. Children may not independently create accounts, purchase subscriptions, manage billing details, or modify account ownership or permissions. All subscriptions must be initiated and maintained by the parent or legal guardian. If we become aware that an account has been created in violation of these age requirements, we reserve the right to suspend or terminate access immediately.
3. NATURE OF THE SERVICES
M.Y.T.E provides digital tools intended to support emotional development, reflection, and resilience-building in children and adolescents. The Services may include structured activities, guided emotional exercises, journaling features in text, audio, and video formats, achievement and progress tracking systems, AI-generated responses and reflective prompts, and parent dashboards designed to provide oversight and insights. The Services are educational and supportive in nature. They are designed to encourage self-awareness, emotional literacy, and constructive habits through structured engagement. However, the Services do not constitute medical, psychological, therapeutic, legal, or educational diagnostic services.
The inclusion of AI-generated features does not convert the Services into professional advisory services. All outputs are provided as informational and reflective tools only. The Services are not intended to replace professional advice, diagnosis, treatment, counselling, or evaluation provided by licensed professionals. Parents remain solely responsible for determining whether the Services are appropriate for their child and for supervising their child’s engagement with all features of the App and Website.
4. PARENTAL RESPONSIBILITY
By creating an account and permitting a child to use the Services, parents and legal guardians acknowledge and agree that they retain full responsibility for supervision, oversight, and safeguarding at all times. The Services are designed to support, not replace, active parental involvement. You agree that you will actively supervise your child’s use of the App and Website and will determine what content your child may upload, record, or share. Parents are responsible for monitoring their child’s interactions with AI-powered features, reviewing content generated by the child, and assessing the appropriateness of AI-generated responses. While the platform may include automated monitoring tools designed to flag potentially concerning content, such tools are not comprehensive and do not eliminate the need for parental oversight. If notified of flagged content, parents are responsible for reviewing the matter and taking any appropriate action.
You further agree that you will control all sharing permissions within the parent dashboard and will ensure that any information shared with third parties, including teachers, therapists, or other professionals, is appropriate and lawful. Parents are responsible for ensuring that all uploaded or recorded content complies with applicable laws and does not infringe upon the rights of others. M.Y.T.E does not assume responsibility for supervising children’s behaviour, interpreting emotional disclosures, or intervening in safeguarding matters. Safeguarding and oversight remain the ongoing responsibility of the parent or legal guardian.
5. ACCOUNT RESPONSIBILITIES
Parents are responsible for maintaining accurate, complete, and current account information at all times. You agree to safeguard your login credentials, maintain the confidentiality of passwords and authentication methods, and take reasonable steps to prevent unauthorized access to your account and associated child profiles. You are solely responsible for all activity that occurs under your account, whether authorized by you or not. If you suspect unauthorized access, misuse, or a security breach, you must notify us promptly so that appropriate measures may be taken. Failure to maintain account security may result in suspension or termination of access.
Children may access only the specific profiles assigned to them through the parent account. Under no circumstances may accounts be shared in a manner inconsistent with their intended use. You may not share accounts with individuals outside your household in a way that circumvents subscription limits, bypass parental controls, or grant unauthorized access to restricted features. Impersonating another individual, misrepresenting identity, or attempting to manipulate role-based permissions is strictly prohibited. We reserve the right to suspend, restrict, or terminate accounts that violate these responsibilities or that present security, legal, or safeguarding risks.
6. ACCEPTABLE USE RULES
Following rules must be followed.
Use of the Services must comply with all applicable laws, safeguarding standards, and these Terms. The Services are designed to provide a safe and supportive environment for children and families, and any misuse that compromises safety, legality, or system integrity is strictly prohibited.
- Users may not upload, post, transmit, or otherwise make available any content that is illegal, unlawful, harmful, abusive, defamatory, fraudulent, or infringing. This includes, without limitation, content that violates intellectual property rights, privacy rights, data protection laws, or safeguarding regulations. The upload, creation, or transmission of sexual content involving minors is strictly prohibited and may be reported to appropriate authorities as required by law.
- Harassment, bullying, intimidation, hate speech, threats, exploitation, or abusive behaviour toward any individual whether within the App or in connection with the Services is not permitted.
- Users may not submit personal data of third parties, including classmates, teachers, family members, or other individuals, without lawful authority and consent where required. Parents are responsible for ensuring that children understand these restrictions.
- Users may not attempt to manipulate or bypass AI safety systems, filters, or moderation mechanisms. Attempts to engineer prompts designed to override safeguards, generate inappropriate outputs, or exploit system vulnerabilities are strictly prohibited. Similarly, users may not reverse engineer, decompile, disassemble, copy, replicate, or attempt to extract source code, training data, algorithms, or underlying model logic from any AI system or technical component of the Services.
- Interference with platform security is prohibited. This includes introducing viruses, malware, spyware, malicious code, automated scraping tools, bots, or any technology intended to disrupt system functionality.
- Unauthorized access to accounts, data, administrative panels, or infrastructure whether by technical exploitation or credential misuse is strictly forbidden.
Any violation of these Acceptable Use Rules may result in immediate suspension, restriction, or termination of access without prior notice. We reserve the right to investigate suspected violations and to cooperate with law enforcement where required. Repeated or serious violations may result in permanent account closure and legal action where appropriate.
7. INTELLECTUAL PROPERTY
All content, materials, features, and functionality available through the App and Website (not including the User-Generated Content) are the exclusive property of the Licensor, M.Y.T.E Mission Ltd (UK). This includes, without limitation, all software, platform architecture, proprietary AI frameworks, and trademarks. These assets are used by the Operator (MYTE Mission Children and Adolescents Skills Development – FZCO) under license. Your use of the Services does not grant you any ownership rights in these materials.
The Services are licensed, not sold, to you. Except as expressly permitted under these Terms, you may not copy, reproduce, distribute, publish, display, transmit, modify, adapt, translate, create derivative works from, reverse engineer, decompile, disassemble, or otherwise attempt to extract source code, algorithms, model structures, or proprietary logic underlying any portion of the Services without our prior written consent. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for personal, non-commercial family use in accordance with these Terms. Any unauthorized use may result in immediate termination and may violate intellectual property laws.
8. USER-GENERATED CONTENT
The Services allow users to create, upload, store, and share original content, including text journals, audio recordings, video entries, images, prompts, and AI interactions (“User-Generated Content”). Parents and children retain ownership of the original content they create and upload to the Services. By submitting User-Generated Content through the App or Website, you grant M.Y.T.E a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, display, transmit, and analyse such content solely for the purpose of operating, maintaining, improving, securing, and providing the Services. This license includes the right to process content through AI systems, apply automated safety screening, generate insights within the parent dashboard, and ensure compliance with safeguarding requirements. This license is limited to functionality, security, and operational purposes.
We do not claim ownership of User-Generated Content, nor do we exploit such content for commercial resale. Except as described in the Privacy Policy or required by law, User-Generated Content will not be shared externally without parental authorization. You represent and warrant that you have all necessary rights, permissions, and authority to upload or submit the content you provide. This includes ensuring that any identifiable third-party information contained within uploads is lawfully disclosed and consented to where required. You further represent that the content does not infringe intellectual property rights, privacy rights, publicity rights, or other legal protections of any person or entity.
We reserve the right, but not the obligation, to remove, restrict, or disable access to User-Generated Content that violates these Terms, applicable laws, or safeguarding standards. We may also retain copies of content as necessary to comply with legal obligations, resolve disputes, enforce agreements, or maintain system integrity. Parents remain responsible for reviewing and supervising the content their child uploads and for managing sharing permissions within the platform.
9. SAFEGUARDING AND MONITORING
To help maintain platform safety, we may use automated systems and moderation tools designed to identify potentially concerning content, including language that may indicate distress, policy violations, or misuse of the Services. These systems may analyse text entries, prompts, and other user interactions for safety and compliance purposes. However, you acknowledge and agree that the Services do not provide continuous monitoring, real-time human review, or guaranteed detection of harmful, unlawful, or high-risk content. Automated systems are inherently limited and may fail to detect certain content or may generate false positives. The absence of a warning, alert, or intervention does not indicate that content has been reviewed or approved by M.Y.T.E.
Reporting Objectionable Content: In compliance with app marketplace guidelines regarding User-Generated Content, the App provides built-in mechanisms for users and parents to report concerning, inappropriate, or objectionable content, and to block abusive users. We will review and act upon all reports of objectionable content within 24 hours of submission.
Flagged content may, where appropriate, be reviewed by authorized administrators for the limited purposes of enforcing these Terms, protecting user safety, complying with legal obligations, or addressing safeguarding concerns. Such review is conducted on a discretionary basis and does not create a duty to monitor or supervise user activity. M.Y.T.E is not a crisis response service, emergency monitoring provider, or mandated reporting agency, except where required by applicable law. We do not assume responsibility for real-time intervention in situations involving emotional distress, self-harm ideation, abuse disclosures, or other high-risk circumstances. Parents and legal guardians remain solely responsible for supervising their child’s use of the Services and for responding to any safeguarding concerns.
If we reasonably determine that a safety risk exists, or that a user has violated safeguarding standards or these Terms, we reserve the right to suspend, restrict, or terminate accounts without prior notice. We may also take additional action where required to protect users, comply with applicable laws, or cooperate with lawful requests from authorities. Use of the Services constitutes acknowledgment that safeguarding tools are supplementary measures and do not replace active parental oversight or professional support where needed.
10. RESULTS DISCLAIMER
M.Y.T.E does not guarantee any specific results or outcomes from the use of the Services. While the App is designed to support emotional awareness, self-reflection, and positive habit formation, individual outcomes will vary and depend on numerous factors outside of our control. These factors include, without limitation, parental involvement, consistency of engagement, the child’s unique personality and developmental stage, family environment, educational setting, prior experiences, and external influences. We make no representations or warranties regarding emotional improvement, behavioural changes, academic performance, therapeutic benefits, psychological development, achievement milestones, resilience outcomes, or any measurable progress. The Services are tools intended to support reflection and growth, but they do not guarantee transformation, success, or advancement in any specific area. All Services are provided strictly on an “as-is” and “as-available” basis. To the fullest extent permitted by applicable law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. We do not warrant that the Services will meet your expectations, operate without interruption, or produce desired outcomes. We do not guarantee that the Services will be uninterrupted, error-free, secure, or available at all times.
11. ARTIFICIAL INTELLIGENCE DISCLAIMER
The App includes AI-powered features that generate automated responses based on user inputs. These systems operate using algorithmic processing and machine-learning models. By using these features, you acknowledge and agree that AI-generated outputs are produced automatically and are not reviewed, validated, or approved in real time by licensed professionals or human moderators. AI responses may be inaccurate, incomplete, outdated, contextually inappropriate, misleading, or inconsistent. The AI may misinterpret prompts, fail to understand nuance, generate unexpected outputs, or provide responses that do not align with user intent. AI systems are inherently probabilistic and may produce content that varies in tone, relevance, or clarity.
AI-generated outputs are provided for informational and reflective purposes only. They do not constitute medical advice, psychological advice, mental health treatment, legal advice, educational assessment, safeguarding determinations, crisis intervention services, or any other form of licensed professional guidance. No therapist–client, doctor–patient, fiduciary, advisory, or professional relationship is created through use of the AI features or any part of the Services. Parents and legal guardians remain solely responsible for reviewing, interpreting, and determining the appropriateness of all AI-generated content for their child. You agree that you will not rely on AI responses as a substitute for independent judgment or qualified professional advice.
12. HEALTH AND MENTAL WELLBEING DISCLAIMER
M.Y.T.E is not a healthcare provider, medical institution, counselling service, psychological practice, psychiatric service, or crisis response organization. The Services are educational and supportive tools intended to encourage reflection and emotional skill development and are not therapy, medical treatment, counselling, psychiatric care, diagnostic evaluation, or behavioural intervention. The Services are not intended to diagnose, treat, cure, or prevent any physical or mental health condition. They are not a substitute for licensed professional services provided by qualified psychologists, psychiatrists, counsellors, therapists, physicians, social workers, or other regulated professionals.
If a child expresses emotional distress, self-harm ideation, suicidal thoughts, abuse disclosures, crisis indicators, or other high-risk circumstances, parents or guardians must immediately seek assistance from qualified professionals or local emergency services. The Services do not provide emergency monitoring, mandated reporting services (except where required by applicable law), or real-time crisis detection. Although automated tools may flag certain language or patterns, we do not continuously monitor user activity and cannot guarantee the identification of high-risk situations. By using the Services, you acknowledge and agree that safeguarding, mental health supervision, and appropriate intervention remain the sole responsibility of the parent or legal guardian. M.Y.T.E assumes no duty to intervene in emergencies, provide medical or psychological treatment, or ensure user wellbeing beyond the functionality expressly described in these Terms.
13. PHYSICAL ACTIVITY DISCLAIMER
Certain App features (including Ask Lucy) utilize artificial intelligence to generate automated suggestions, which may include emotional regulation exercises, breathing techniques, mindfulness activities, stretching guidance, light physical movements, grounding practices, or other wellbeing-related activities (collectively, “Suggested Activities”). You acknowledge and agree that all Suggested Activities are generated automatically through algorithmic systems and are provided for general informational and educational purposes only. These suggestions are not tailored medical, therapeutic, physiotherapy, or fitness instructions and are not intended to diagnose, treat, cure, or prevent any medical or psychological condition.
Some Suggested Activities may involve physical movement, posture adjustments, stretching, breathing techniques, or other bodily actions. There is an inherent risk of physical discomfort or injury if exercises or movements are performed incorrectly, excessively, without proper technique, without appropriate physical capability, or despite pre-existing medical conditions. M.Y.T.E does not evaluate a child’s physical health, medical history, coordination level, injuries, or physical limitations before generating AI suggestions. By using any of our App’s features and engaging in any Suggested Activities, you acknowledge and accept that participation in such activities is voluntary and undertaken at your own risk. M.Y.T.E shall not be responsible for any injury, strain, physical harm, adverse reaction, emotional discomfort, or other consequences resulting from the performance, improper execution, or misunderstanding of Suggested Activities.
Parents and legal guardians remain responsible for determining whether Suggested Activities are appropriate for their child’s age, developmental stage, physical condition, and overall wellbeing. The parent, as the primary account holder, assumes full responsibility for evaluating the suitability of any AI-generated guidance and for ensuring that use of the Services aligns with the child’s individual needs and capabilities. If a child has a medical condition, prior injury, physical limitation, respiratory condition, neurological condition, or any other health concern, consultation with a qualified healthcare professional should be sought before engaging in physical or breathing-related activities suggested by the AI. The availability of Suggested Activities does not create a healthcare provider–patient relationship, fitness trainer relationship, therapeutic relationship, or any other professional advisory relationship between M.Y.T.E and any user. To the fullest extent permitted by law, M.Y.T.E disclaims liability for any injuries, losses, or damages arising out of or related to the use of AI-generated Suggested Activities, including but not limited to improper technique, overexertion, misunderstanding of instructions, or failure to follow safe practices.
14. THIRD-PARTY ACCESS
The Services allow parents or legal guardians to authorize limited access to certain information for third parties, such as teachers, therapists, SENCOs, educational institutions, or secondary guardians. Any such access is initiated, configured, and controlled exclusively by the parent through the available dashboard tools. Parents are solely responsible for determining what information is shared, with whom it is shared, and for how long access remains active. Before granting access, parents should carefully review the scope of data being disclosed. Parents are also responsible for revoking access when it is no longer appropriate or necessary. Third-party recipients are independent parties and are not agents, partners, or representatives of M.Y.T.E. Once information is lawfully shared at the parent’s direction, we do not control and are not responsible for how those third parties store, use, process, or further disclose that information. Parents acknowledge that sharing data externally may subject that data to the privacy practices of the receiving party.
15. SUBSCRIPTIONS AND BILLING POLICY
Access to certain features of the Services requires a paid subscription. Subscriptions may be offered on a monthly or annual basis, as described at the time of purchase. By subscribing, you authorize us and our designated payment processor to charge the applicable subscription fees to your selected payment method on a recurring basis. Unless otherwise stated at the time of purchase, subscriptions automatically renew at the end of each billing cycle. By enrolling in a subscription, you agree that charges will recur automatically until you cancel in accordance with the cancellation procedures described within your account settings. You are responsible for ensuring timely cancellation prior to the renewal date if you do not wish to continue the subscription.
Pricing may vary by region, currency, applicable taxes, promotional offers, or plan selection. We reserve the right to modify subscription pricing, introduce new plans, or adjust existing plan structures. Where required by applicable law, we will provide advance notice of material pricing changes before they take effect. Payment processing is conducted through secure third-party payment providers, such as Stripe, or through mobile platform billing systems where applicable. We do not store full payment card details on our servers. Your use of third-party payment services is subject to their respective terms and privacy policies. Failure to maintain valid payment information may result in suspension or termination of access to subscription features.
15.1. Refund Policy
Unless otherwise required by applicable law, subscription fees are non-refundable once charged. We do not provide refunds or credits for partially used billing periods, unused features, or mid-cycle cancellations. When a subscription is cancelled, access to paid features will generally continue until the end of the current billing period, after which renewal charges will cease. In limited circumstances, we may, at our sole discretion, issue a refund or credit. The decision to grant any discretionary refund does not create an obligation to issue similar refunds in the future. For consumers located in the United Kingdom or European Union, statutory cooling-off rights may apply to digital services purchased online. Where applicable law provides a mandatory withdrawal period, you may exercise those rights in accordance with the instructions provided at the time of purchase. However, by expressly requesting immediate access to digital services, you may waive certain statutory withdrawal rights to the extent permitted by law.
15.2. Third-Party Refund Status
If a subscription is purchased through a third-party platform such as the Apple App Store or Google Play, billing and refund requests are governed by the policies of those platforms. In such cases, we do not control and are not responsible for the refund processes of those app marketplaces, and you must contact the applicable platform provider directly.
16. TERMINATION
We reserve the right, at our sole discretion, to suspend, restrict, or terminate access to the Services, in whole or in part, at any time and with or without prior notice, if we reasonably believe that a user has violated these Terms, misused the Services, engaged in fraudulent activity, created security or safeguarding risks, or where termination is required to comply with applicable laws, regulatory obligations, court orders, or lawful governmental requests. Suspension or termination may also occur where account activity presents a risk to the safety, privacy, or rights of other users, compromises the integrity or security of the platform, or attempts to circumvent technical safeguards, subscription controls, or content moderation systems. In certain circumstances, we may investigate suspected violations and restrict access while such investigation is ongoing.
Parents or legal guardians may delete their accounts at any time through the parent dashboard or by contacting customer support. Upon voluntary termination, access to subscription features will cease at the end of the applicable billing period unless immediate termination is requested. Deleting an account does not automatically entitle the user to a refund, except where required by applicable law or expressly stated in our Refund Policy. Termination, whether initiated by the user or by M.Y.T.E, does not relieve the parent or account holder of any outstanding payment obligations incurred prior to the effective date of termination. Any unpaid fees, chargebacks, or disputes remain payable and may be pursued to the extent permitted by law.
Upon termination, we may disable access to the account and associated child profiles. Data handling following termination will be governed by our Privacy Policy, including applicable retention and deletion timelines. We reserve the right to retain certain information where necessary to comply with legal obligations, resolve disputes, enforce agreements, or protect platform security. Certain provisions of these Terms, including but not limited to disclaimers, limitations of liability, indemnification obligations, intellectual property protections, and dispute resolution clauses, shall survive termination to the fullest extent permitted by law.
17. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, the Operator (MYTE Mission Children and Adolescents Skills Development – FZCO), together with its affiliates, officers, directors, employees, contractors, service providers, and licensors, shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or relating to the use of, or inability to use, the Services.
This limitation includes, without limitation, claims related to emotional distress, psychological harm allegations, loss of data, interruption of service, loss of profits, reputational damage, reliance on AI-generated outputs, or safeguarding-related claims. We are not liable for user-generated content, third-party conduct, or the actions of individuals granted access through parental authorization.
In no event shall the total aggregate liability of the Operator for all claims arising out of or relating to the Services exceed the total amount paid by the parent or account holder to the Operator in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not permit certain exclusions or limitations of liability. In such cases, liability shall be limited to the maximum extent permitted under applicable law.
18. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the Operator (MYTE Mission Children and Adolescents Skills Development – FZCO), together with its affiliates, officers, directors, employees, agents, service providers, and licensors, from and against any and all claims, liabilities, damages, losses, expenses, and costs (including reasonable legal fees) arising out of or relating to:
- misuse of the Services by you or your child;
- any User-Generated Content uploaded, submitted, or shared through your account;
- violation of these Terms;
- breach of applicable laws or regulations;
- infringement of intellectual property, privacy, or other rights of third parties; and
- claims arising from data shared with third parties at your direction.
This indemnification obligation survives termination of your account and continued use of the Services.
19. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms, and any dispute, claim, controversy, or cause of action arising out of or relating to the Services, shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to conflict of law principles. Any dispute that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the competent courts of the United Arab Emirates, unless mandatory consumer protection laws in the user’s country of residence require otherwise. Prior to initiating formal proceedings, the parties agree to attempt in good faith to resolve any dispute through written notice and informal negotiation for a period of at least thirty (30) days. Nothing in this section limits non-waivable statutory rights that consumers may have under applicable mandatory laws. If any provision of this dispute resolution clause is held unenforceable in a particular jurisdiction, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
20. FORCE MAJEURE
M.Y.T.E shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control. Such causes include, without limitation, acts of God, natural disasters, pandemics, governmental actions, regulatory changes, war, terrorism, civil unrest, labour disputes, internet or telecommunications failures, cyberattacks, cloud service interruptions, power outages, or failures of third-party service providers. During any force majeure event, performance obligations shall be suspended for the duration of the event. We shall make commercially reasonable efforts to restore Services as soon as practicable.
21. NO WAIVER
Failure by M.Y.T.E to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of MYTE Mission Children And Adolescents Skills Development FZCO.
22. ASSIGNMENT
You may not assign, transfer, delegate, or sublicense any rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, restructuring, or sale of assets, provided that your rights under these Terms are not materially reduced.
23. SURVIVAL
Any provisions of these Terms which by their nature should survive termination shall survive, including but not limited to intellectual property rights, disclaimers, limitations of liability, indemnification obligations, dispute resolution provisions, and governing law clauses.
24. LANGUAGE AND INTERPRETATION
These Terms are drafted in the English language. In the event of translation into another language, the English version shall prevail to the extent permitted by applicable law. Headings are provided for convenience only and shall not affect interpretation.
25. SEVERABILITY
If any provision is found unenforceable, the remainder remains in effect.
26. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, constitute the entire agreement between you and M.Y.T.E.
27. CHANGES TO SERVICES
We may modify features, pricing, or functionality at any time. Continued use constitutes acceptance of updates.
28. APP STORE SPECIFIC TERMS
If you download the App from the Apple App Store, the following terms apply:
- Acknowledgment: These Terms are concluded between you and M.Y.T.E only, and not with Apple Inc. (“Apple”). M.Y.T.E, not Apple, is solely responsible for the App and its content.
- Maintenance and Support: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
- Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
